We have been discussing this issue some at a staff level and I need to make certain that I was clear in my response to you.

 

Your proposed resolution will not and cannot be acted on by the Council as a part of the Agenda on Monday. Council cannot take any action on an item not on an Agenda, and the Agenda for Monday is already set.

 

What you can do during the public participation section is discuss the issues related to the proposed resolution and request that the Council either put the resolution on the next Council Agenda (March 17) or on an Agenda for a Special Meeting if the Council has an interest in scheduling such a meeting to take action on your proposal. I have not spoken with any of the Council members and so have no idea as to what they would or would not be willing to consider on this issue.

There will be two places on the Agenda for Public Participation on items not otherwise on the Agenda. The first will be near the beginning of the meeting, likely prior to any of the regular business. The second will be at the normal location on the Agenda, towards the end after the conclusion of the published items of business.

 

A member of the public will have the opportunity to speak at either (but not both) of those times on any issue.

Subject: URGENT - Please attend City Council Meeting - MONDAY

Dear PeaceAware,

We need your help. Our Peace and Civil Liberties Resolution needs to get on the Las Cruces City Council agenda (note we will take this Mesilla, then Dona Ana County after we win this one). To start the process, we must make a presentation on Monday - Why this resolution merits being on the agenda? A vote will be taken on "should the resolution be put onto the agenda at their next meeting?"

URGENT - Please attend the March 3 (Monday) 1PM meeting at City Hall 200 N. Church Street. I  think the "PUBLIC PRESENTATION section" of the meeting will happen after regular business, between 3PM or closer to 5PM.  Please RSVP dboje@nmsu.edu if you can attend.  The more people that are there, even if a few of us speak, will be a positive message of support.

Second, please send a letter or email.

If you would like for the City Council to formally consider an issue, you will either need to have the Mayor Pro-tem put it on the Agenda, or get four members of the City Council to put it on the Agenda.  This is the protocol established by the City Charter.
 
If the issue that you would like to have consideration of is reflected in your attachment, I believe that you will need to have someone attend the next meeting (Monday March 3, beginning at 1:00 pm) and make that request to Council during the Public Presentation section of the meeting.  It will be up to a majority of the Council if they wish to have it on an upcoming meeting for consideration.  It would not be considered at the Monday March 3rd meeting since that Agenda is already set.  It would have to be at a future Regular or Special Meeting.
